Terms of Service

These Terms of Service ("Terms") govern your access to and use of Psycled, including our app, website, account features, journaling tools, emotion and context tracking, AI-powered analysis, subscription features, and related services (collectively, the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who We Are

Psycled is a reflective journaling service designed to help users record daily moods, situations, memories, and emotional patterns. For questions about these Terms or the Service, contact us at chowonlee@psycled.com.

2. Eligibility

The Service is not intended for children under the age of 13, or under 16 where required by the laws of your country of residence. By using the Service, you represent that you meet the applicable minimum age requirement and have the legal capacity to agree to these Terms.

3. Accounts and Security

You may need an account to use certain features. You are responsible for keeping your account information accurate and for maintaining the confidentiality of your login credentials. You must not share, sell, transfer, or allow another person to use your account.

If you believe your account has been accessed without authorization, please contact us promptly.

4. The Service

Psycled may provide features that allow you to write and save diary entries, track emotions and situations, archive entries, receive AI-powered emotional or psychological analysis, and access premium or subscription-based features.

We may modify, suspend, or discontinue all or part of the Service when needed for maintenance, security, product improvement, legal compliance, or operational reasons.

5. AI-Powered Analysis

Psycled may use artificial intelligence models, including providers such as OpenAI, to analyze text you submit and provide personalized emotional or psychological feedback. AI-generated outputs are provided for reflection and informational purposes only.

The Service is not a medical device and does not provide medical, psychological, psychiatric, legal, or other professional advice. AI analysis does not replace diagnosis, therapy, counseling, treatment, or support from a qualified professional. If you are experiencing a crisis, emergency, or serious mental health concern, seek immediate help from local emergency services or a qualified professional.

6. Your Content

You retain ownership of diary entries, text, and other content you create or submit through the Service ("User Content"). You are responsible for your User Content and for ensuring that it does not violate any law or the rights of others.

You grant Psycled a limited, worldwide, non-exclusive license to host, store, process, transmit, display, and use your User Content only as needed to provide, secure, maintain, improve, and personalize the Service, including AI analysis features.

We may use anonymized or aggregated information that cannot reasonably identify you for research, analytics, product improvement, market analysis, and commercial purposes.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you acknowledge that your information may be processed by service providers such as Supabase, OpenAI or related AI providers, RevenueCat, Apple, and Google, as described in the Privacy Policy.

8. Subscriptions and Payments

Some features may require a paid subscription or in-app purchase. Payments may be processed through the Apple App Store or Google Play. Psycled does not directly collect or store sensitive financial information such as credit card numbers.

Subscription pricing, renewal terms, cancellation options, refunds, and billing issues are generally governed by the applicable app store terms and policies. You can manage or cancel subscriptions through your Apple App Store or Google Play account settings.

9. Acceptable Use

You agree not to misuse the Service or help anyone else misuse it. You must not:

  • Use the Service in violation of applicable laws or regulations.
  • Access another person's account or personal information without permission.
  • Upload or submit unlawful, harmful, abusive, hateful, harassing, or infringing content.
  • Interfere with, disrupt, reverse engineer, scrape, crawl, or overload the Service.
  • Use automated systems, bots, or scripts without our prior written permission.
  • Use the Service to develop competing models, datasets, or services without authorization.
  • Submit sensitive personal information about others without a lawful basis and their consent.

10. Third-Party Services

The Service may rely on or link to third-party services, including cloud hosting, authentication, payment, subscription management, and AI providers. We are not responsible for third-party services, and your use of them may be subject to their own terms and privacy policies.

11. Intellectual Property

Psycled and its software, design, branding, logos, interfaces, features, and content are owned by Psycled or its licensors and are protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.

12. Termination

You may stop using the Service at any time and may delete your account through the app where available. We may suspend or terminate access to the Service if you violate these Terms, create risk for other users, or expose Psycled to legal or security risk.

13. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Psycled disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

14. Limitation of Liability

To the fullest extent permitted by law, Psycled will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, service interruption, or unauthorized access, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice through the Service, in-app notification, email, or another appropriate method. Your continued use of the Service after the updated Terms take effect means you accept the updated Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Korea, without regard to conflict of law principles, unless the laws of your country of residence require otherwise. We will first try to resolve any dispute with you informally and in good faith.
